Can NRIs buy residential property in India? The basics

Non resident Indians are generally permitted to purchase residential and commercial property in India without needing special approval, since this falls within the ordinary permissions granted under India's foreign exchange framework for people of Indian origin living abroad. This makes residential property one of the more straightforward categories of asset for NRIs to acquire compared with certain other investment classes.

Purchases are typically funded either through remittances sent from abroad into an appropriate Indian bank account, or through funds already held in an NRE or NRO account within India, rather than through cash transactions, which are strongly discouraged and often restricted under regulatory guidance. Payment channels and documentation are generally scrutinised more closely for property transactions than for everyday remittances.

While the purchase itself is broadly permitted, NRIs still need to navigate the same due diligence, registration and tax considerations that apply to any property buyer in India, alongside some additional requirements specific to non resident status. Because rules around repatriating sale proceeds later can be more involved than the purchase itself, it is worth thinking through the full ownership cycle, not just the acquisition step.
